' Justice France Feilding jurors too close The murder trial resulting from the death of Feilding farmer Scott Guy is to be held in Wellington. Justice Simon France announced last week the trial, expected to last up to six weeks, would move from Palmerston North to Wellington because of the risk that jurors may be influenced by rumour and specu- lation alive in the district. Ewen Kerry Macdonald, 31, is accused of killing his brother-in-law outside Mr Guy's Aorangi Rd farm- house, near Feilding, on July 8 last year. The majority of Justice France's ruling was suppressed, but he said that the trial would start on the same date -- June 5 next year. Defence lawyer Peter Coles made the application for Macdonald's venue change at a pre-trial hearing in the High Court at Wellington this week, but discussions with Justice France were also suppressed, as were all but one paragraph of his ruling. There are risks that jurors drawn from the Palmerston North jury district, including Feilding, will be influenced by the amount of speculation and rumour there has been about the case and about Mac- donald and Mr Guy in particular,'' Justice France's decision said. He ruled jurors were likely to have information about the case or people involved, some of which would be incorrect. This means the ability to remove its potential influence is lessened.'' Professor Mark Henaghan, from Otago University's law faculty, said one reason for the move was that justice must be seen to be done. And holding the trial in Palmer- ston North would possibly increase pressure on jurors, particularly if they were from Feilding. Who'd want to be on a jury if everyone tells you what they think?'' Prof Henaghan said. The over-riding issue always is a fair trial.'' Justice France is yet to make a decision on an application to do with the admissibility of evidence. Macdonald has been in custody since his arrest on April 7 after a nine-month police investigation.
